1. The seller
The website makolate.store is operated by Chipcolate S.r.l., with registered office at Piazza della Repubblica 19, 20124 Milan (MI), Italy. VAT ID: 12207370961. In these terms, “Chipcolate”, “we” or “us” refers to the company above; “Customer”, “you” or “User” refers to the natural person purchasing for purposes outside their trade, business, craft or profession (consumer under art. 3 of Legislative Decree 206/2005, the “Italian Consumer Code”).
2. Scope
These Terms & Conditions govern the use of makolate.store and the purchase of the goods offered — personalised 3D-printed objects. By placing an order you confirm that you have read, understood and accepted these terms.
3. Contract formation
Product listings on makolate.store are an invitation to treat. Your order is an offer to buy. The contract is concluded when you receive email confirmation that payment has been authorised by our payment processor. A durable copy of the order and of these terms is provided alongside the confirmation.
4. Personalised goods
All goods offered on makolate.store are made to your specifications or clearly personalised in the configurator. This nature is relevant to the right of withdrawal (see section 8).
5. Pricing and payment
All prices are shown in Euro and include VAT at the applicable rate. Any delivery charges and customs duties are shown separately at checkout, before you confirm the order. Payments are processed by Stripe Payments Europe Limited; Chipcolate never directly receives or stores your card data.
6. Delivery
Goods are delivered by a carrier selected at checkout. Delivery times are estimates and run from order confirmation. Risk of loss or damage passes to you at the point of physical delivery.
7. Statutory warranty of conformity
Under arts. 128 to 135 quinquies of the Italian Consumer Code, you are entitled to a statutory warranty of conformity lasting 24 months from delivery. If the goods are not in conformity, you may choose between repair and replacement, except where the chosen remedy is objectively impossible or disproportionate to the other. To invoke the warranty, contact [email protected] within 2 months of discovering the defect.
8. Right of withdrawal
The 14-day right of withdrawal under arts. 52 and following of the Italian Consumer Code does not apply to contracts for goods made to the consumer’s specifications or clearly personalised, under art. 59(1)(c) of the Italian Consumer Code. Because every product offered on makolate.store is personalised to the Customer’s specifications, the right of withdrawal is excluded. Your statutory rights regarding non-conforming goods are unaffected (see section 7).
9. Limitation of liability
To the extent allowed by mandatory consumer-protection law, Chipcolate is liable only for direct and foreseeable damage at the time the contract was concluded, and only where caused by its own breach. The rights granted to consumers by the Italian Consumer Code and other mandatory rules are not affected.
10. Intellectual property
makolate.store, the configurator software, product templates, trademarks and graphic content are protected by intellectual property rights belonging to Chipcolate or to the respective rights holders. Unauthorised reproduction, distribution or commercial use is prohibited. Files and content you upload into the configurator remain yours; you warrant that you hold the rights necessary for their use in the production of the personalised goods and you indemnify Chipcolate against any third-party claims in this regard.
11. Personal data
Your personal data is processed as described in the Privacy Policy, which forms part of these terms.
12. Governing law and jurisdiction
These terms are governed by Italian law. Any dispute arising out of the contract is subject to the exclusive jurisdiction of the court of the consumer’s place of residence or domicile within Italy, under art. 66-bis of the Italian Consumer Code.
13. Online dispute resolution (ODR)
Under art. 14 of Regulation (EU) No 524/2013, we inform you that the European Commission provides an online dispute resolution platform, available at ec.europa.eu/consumers/odr. Our reference email is [email protected].
14. Changes
Chipcolate may update these terms at any time. The version applicable to a specific order is the one in force at the time the contract is concluded, except where a change is required by mandatory law.
